🇮🇪 Irish Healthcare & Home Support Regulatory Hub

Ireland Healthcare Compliance Hub

An operational governance blueprint for Irish home care providers, nursing agencies, and nursing homes to navigate HIQA inspection standards, Garda Vetting, and Workplace Relations Commission (WRC) employment law.

1

HIQA National Standards & Inspection Readiness

Health Information and Quality Authority • Health Act 2007

HIQA monitors compliance in designated residential centres, nursing homes, and sets national standards for home support services. Under the Health Act 2007 and thematic inspection programmes:

  • Safe Staffing (Regulation 15): Providers must demonstrate that the numbers and skill-mix of staff are appropriate to the assessed needs of service users.
  • Training & Development (Regulation 16): Complete records of induction, continuous professional development (CPD), and mandatory refresher training must be maintained.
  • Governance & Management (Regulation 23): Defined management structures, annual reviews of quality and safety, and clear escalation pathways for clinical risks.
  • Notification of Incidents: Timely submission of statutory notifications (NF01 to NF07) regarding adverse incidents, medication errors, and safeguarding concerns.
2

National Vetting Bureau (Garda Vetting) Obligations

National Vetting Bureau (Children and Vulnerable Persons) Acts 2012 to 2016

Under Irish law, deploying a care worker or nurse without completed Garda Vetting is a statutory criminal offence:

  • eVetting Disclosure Prior to Deployment: A satisfactory disclosure must be received prior to starting any relevant work with children or vulnerable adults.
  • 3-Year Statutory Re-Vetting Cycle: In accordance with HSE tender requirements and HIQA standards, staff must be re-vetted every 3 years.
  • Joint Agreements & Agency Deployments: Nursing and healthcare agencies must provide client facilities with certified written confirmation of vetting prior to shift commencement.
3

Organisation of Working Time Act (OWTA 1997) & Pay Rules

Workplace Relations Commission (WRC) Enforcement

Care agencies must strictly uphold Irish working time protections and maintain working time records for at least three years:

  • Maximum 48-Hour Working Week: Calculated as an average over a statutory 4-month reference period.
  • Mandatory Daily Rest (11 Consecutive Hours): Carers must receive 11 uninterrupted hours of rest in each 24-hour window between shifts.
  • Weekly Rest Period: At least 24 consecutive hours of rest in each 7-day period (or 48 hours over a 14-day cycle).
  • Sunday Premium (Section 14): Statutory entitlement to an enhanced rate or paid time off in lieu for rostered Sunday work.
4

Professional Credentialing (NMBI & CORU)

Nurses and Midwives Act 2011 • Health and Social Care Professionals Act 2005

Temporary nursing agencies and hospital staffing desks must conduct continuous registration verification:

  • NMBI Live Register: Active validation of candidate PINs, division of registration (General, Psychiatric, Children\'s, Intellectual Disability), and Annual Retention Fee payments.
  • CORU Registers: Verification for Social Care Workers, Physiotherapists, and Occupational Therapists practicing in designated health settings.
  • Immigration & Work Permissions: Verification of Stamp 1, Stamp 4, and Employment Permits issued by the Department of Enterprise, Trade and Employment (DETE).
5

HSE Service Frameworks & Electronic Visit Verification

HSE Primary Care & Community Healthcare Organisations (CHOs)

Providers delivering care under the national tender framework must maintain verified electronic evidence of care delivery:

  • Electronic Visit Verification: GPS geofenced mobile verification of visit start and finish times to substantiate billed hours.
  • Purchase Order Matching: Direct reconciliation between authorized HSE care package hours and actual care delivered.
  • Safeguarding Governance: Full adherence to the Children First Act 2015 and HSE Safeguarding Vulnerable Persons at Risk of Abuse policy.
